Welcome
These are the rules for using movieposterarchives.org, our Repository, our Auction, and any other service we offer online. By using the site, you agree to them. If you do not agree, please do not use the site.
We try to keep these terms short and readable. If anything is unclear, email us and we will explain.
About us
Movie Poster Archives ("MPA," "we," "us," or "our") is a 501(c)(3) nonprofit film archive organized under the laws of the State of Louisiana. Our EIN is 81-4277585. We were founded in 2016 to preserve and document the visual history of cinema.
Who may use the site
You must be at least 18 years old to create an account, place a bid, or make a purchase. By using the site you confirm that you are.
If you create an account, you are responsible for keeping your password secure and for everything that happens under your account. Tell us right away if you think your account has been used without your permission.
Using the site responsibly
Please do not:
- Use the site to do anything illegal, harmful, or deceptive.
- Place bids you do not intend to honor.
- Bid on your own items or arrange for someone to bid on your behalf to drive up a price ("shill bidding").
- Scrape, copy, or republish the Repository content in bulk without written permission.
- Attempt to break the site's security, reverse-engineer it, or interfere with how it runs.
- Impersonate anyone, or pretend to be affiliated with MPA when you are not.
We can suspend or close any account that breaks these rules.
Auctions and purchases
Bidding is binding
When you place a bid, you are making a binding offer to buy the item at that price. If your bid wins, you are obligated to pay for the item, plus shipping and any applicable taxes.
Retractions
We do not allow bid retractions once a bid has been placed. If you believe you made a genuine mistake (for example, entered $500 instead of $50), email us before the auction closes. We will decide at our discretion whether to correct it.
Payment
Winners must pay within seven days of the auction close using Stripe or PayPal through the checkout on this site. Unpaid items may be re-listed, cancelled, or offered to the next-highest bidder at our discretion, and repeated nonpayment can result in account suspension.
Shipping and taxes
We ship through Shippo. Shipping charges are shown at checkout. Items are shipped from the United States, and international buyers are responsible for any import duties, VAT, or customs charges levied by their country. Risk of loss passes to the buyer when the item is handed to the shipping carrier; we insure shipments where we can and handle claims for lost or damaged items in good faith.
Condition of items
Every item in MPA's auctions is described and photographed to the best of our ability. Most items are vintage paper — posters, lobby cards, pressbooks, stills — and will show age-appropriate wear. We describe material flaws we can see, but we are human and we sometimes miss things. Items are sold "as described, where is." If an item arrives materially different from its description, email us within seven days of delivery and we will make it right.
Authenticity
Our research team does its best to identify, date, and catalog each piece accurately, but we cannot guarantee authenticity beyond what we describe in each listing. If you believe an item has been misattributed, please email us — accuracy matters to us.
Returns
Because most items are one-of-a-kind originals, auction sales are final except in the case of a material mis-description. In that case, email us within seven days of delivery.
Donations
Movie Poster Archives is a 501(c)(3) nonprofit. Donations made through this site are tax-deductible to the extent allowed by U.S. law. We will send you a written acknowledgement for any donation of $250 or more. Donations are non-refundable except in the case of a processing error.
Intellectual property
The text, layout, original photography, and curated content on this site are owned by MPA or licensed to us. Movie posters and other archival images we display are the intellectual property of their original rights-holders (studios, artists, estates). We present them here for historical, educational, and archival purposes.
You may view, share links to, and quote reasonable excerpts from our pages for personal or educational use, with attribution to Movie Poster Archives. Any commercial reuse — including republishing our photography, reselling our images, or training machine-learning models on our content — requires our written permission.
If you believe content on the site infringes a copyright you own, email us with the details required by the Digital Millennium Copyright Act (DMCA) and we will review it promptly.
User submissions
If you submit content to us — for example, by asking a research question through "Ask the Archivist" or sending a photo of a poster you own — you keep ownership of what you submit. You give us a non-exclusive, worldwide, royalty-free license to use that content to respond to your request and, if appropriate, to include anonymized summaries in our research archive. We will not publish identifying personal details without your permission.
Disclaimers
We run this site as a nonprofit, on a best-effort basis. The site is provided "as is" and "as available." We do our best to keep it accurate and online, but we do not promise that it will be uninterrupted, error-free, or secure at all times, or that every description or date is perfect.
Limitation of liability
To the fullest extent allowed by law, MPA's total liability to you for any claim relating to the site or to a purchase is limited to the amount you paid for the item that gave rise to the claim, or one hundred U.S. dollars, whichever is greater. MPA will not be liable for indirect, incidental, or consequential damages such as lost profits, lost data, or emotional distress. Some jurisdictions do not allow these limitations, and in those places our liability is limited to the maximum extent allowed.
Indemnification
If your use of the site causes a claim or loss to a third party — for example, you reuse our images commercially without permission — you agree to cover our reasonable costs of responding.
Governing law and disputes
These terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-law rules. Any dispute between you and MPA that we cannot resolve by talking about it first will be brought in the state or federal courts located in Jefferson Parish, Louisiana, and you and MPA consent to the personal jurisdiction of those courts.
Before filing any lawsuit, please email us and give us 30 days to try to work it out. Most things can be fixed with a conversation.
Changes to these terms
We may update these terms from time to time. When we do, we will change the "Last updated" date at the top. Material changes will also be announced on the homepage for at least 30 days. Continued use of the site after a change means you accept the new terms.
Severability
If any part of these terms is found unenforceable, the rest still applies.
